Police Officers' and Firefighters' Pension(HB 1030)
Police Officers' and Firefighters' Pension Reform Commission.
Requires all contribution deposits for police officers' and firefighters' new
hire pension plans and the statewide death and disability plan to be made
10 days following the payment of salary to the member, regardless of
whether a member is paid more than once per month.

Bioscience Research Grants(HB 1060)
Establishes within the bioscience discovery evaluation grant
program ("program") separate maximum grant amounts for research
projects based on whether a research project is funded by grants received
pursuant to a federal agency small business innovation research ("SBIR")
program or a federal agency small business technology transfer ("STTR")
program. Specifies which portion of moneys appropriated to the
bioscience discovery evaluation cash fund shall be used to provide grants
to SBIR and STTR research projects and which portion shall be used to
provide grants to other research projects. For the portion of moneys
appropriated to the bioscience discovery evaluation cash fund that shall
be used to provide grants to SBIR and STTR research projects, specifies
which portion shall be used to provide grants to biofuel research projects
and which portion shall be used to provide grants to life sciences research
projects. Establishes eligibility criteria for an office of technology
transfer that seeks a grant from the program for the purposes of an SBIR
or STTR research project.
Increases the amount the office of economic development may
expend in administering the program.
Transfers $2,500,000 of the general fund portion of limited gaming
fund moneys to the program.
Makes an appropriation.

Increase Older Coloradans Cash Fund (HB 1100)
In all future state fiscal years, increases the amount allocated to the
older Coloradans cash fund from the receipts collected from the state
sales and use tax. Decreases the allocation to the general fund by an
amount equal to the increase.

Construction Contract Payment (HB 1115)
Requires an owner to provide evidence, before and at all times
during a construction project, to a contractor and subcontractor that
moneys are available for payment to the contractor and subcontractor
when due.
Requires a contractor and any subcontractors to submit monthly
progress payment requests that include all work that was performed on
the project during the previous month to the owner or the owner's
designated representative. Allows for the following remedies, if payment
is not made within the prescribed period:
Suspension of performance by the contractor;
An increase in the time allowed the contractor to complete
the contractor's work;
Reasonable and necessary demobilization and
remobilization costs; and
Interest and attorney fees.
Prohibits withholding retainage from a contractor, subcontractor,
or second-tier contractor.
Establishes that the venue for any suit, arbitration, or other
proceeding brought shall be in the state of Colorado .
Exempts any construction or improvement to a single-family
dwelling or a multi-family dwelling with no more than 2 units.
Allows for freedom to contract; except that the obligations of good
faith and fair dealing may not be disclaimed by contract. Voids a contract
that attempts to include a provision or clause stating that a party to a
construction contract cannot suspend performance under the contract.

License Retail Tobacco Sellers (HB 1233)
Requires a person that engages in the retail sale of cigarettes or
tobacco products to first obtain a license from the department of revenue.
Establishes requirements for license application, issuance, fees, renewal,
suspension, and revocation. Requires the executive director of the
department to maintain a website displaying lists of issued licenses.
Clarifies that a license is a privilege and not a property right. Specifies
that a license is nontransferable. Imposes requirements concerning proof
and display of a license. Specifies that a licensee shall require proof of
identification prior to making a sale to confirm that consumers are at least
18 years of age. Requires a licensee to maintain cigarette or tobacco
product transaction records. Establishes civil and criminal penalties for
violating the laws governing the licensing of retail cigarette or tobacco
product sales.

Rural Telecommunications Development (HB 1250)
Makes legislative findings. Directs the public utilities commission
(PUC) to provide for a uniform, statewide allowable intrastate rate of
return for rural telecommunications providers that is no less than the
interstate rate of return allowed by the federal communications
commission. Allows a rural telecommunications provider to elect
simplified regulatory treatment, consisting of price regulation (as opposed
to traditional, rate-of-return regulation) in the provision of basic local
exchange service and a number of other features, including:
Limits on PUC jurisdiction regarding the provider's
designation as an eligible telecommunications carrier under
federal law;
PUC review of price changes only upon complaint;
Relaxed reporting requirements concerning service quality;
and
Financial assistance from the existing high cost support
mechanism.
Allows cooperatively owned and operated rural
telecommunications providers to exempt themselves from regulation using
substantially the same procedure as is provided under existing law for
cooperative electric associations.

Finances Of State Parks Division (HB 1316)
Extends to July 1, 2012, the
authority of the board of parks and outdoor recreation in the department
of natural resources to establish by rule the amount of fees for use of
facilities and programs of the division of parks and outdoor recreation.
Increases the allowable balance in the parks and outdoor recreation
emergency reserve cash fund to $1 million for the 2007 fiscal year and
allows the balance to increase by 1% of the appropriation for state park
operations until the balance reaches 10% of the annual appropriation for
state park operations.

Athletic Trainer Practice Act (SB 024)
Requires an
athletic trainer to obtain and possess a valid license issued by the director
of the division of registrations in the department of regulatory agencies
(director) before engaging in the practice of athletic training or
representing himself or herself as an athletic trainer. Specifies the criteria
for licensure. Allows the director to issue a temporary permit to an
applicant whose application presents prima facie evidence of compliance
with the licensure criteria. Authorizes the director to establish a schedule
of renewal dates and requires renewal of the license in accordance with
that schedule. Allows the director to set fees for the issuance of a new,
renewed, or reinstated license.
Establishes exceptions to the applicability of the act to specified
persons. Sets forth grounds for disciplinary actions by the director and
the types of disciplinary actions that may be taken, including issuance of
a letter of admonition, denial, refusal to renew, suspension, or revocation
of a license, placement of a licensee on probation, or issuance of a cease
and desist order. Specifies the procedure for investigating and
disciplining a licensee and for judicial review of a disciplinary action by
the director.
Allows the director under certain circumstances to order a licensee
to undergo a mental or physical examination to determine whether the
licensee can practice athletic training with reasonable skill and safety.
Sets forth conduct or actions that constitute a violation of the act and the
criminal penalties for such conduct or actions.
Requires the director to appoint an advisory committee to assist in
the performance of his or her duties, including the adoption of rules
necessary for the administration of the act.
Sunsets the advisory committee and the regulation of athletic
trainers on July 1, 2017.

Drunk Driver BAC Test Election (SB 154)
Requires a law enforcement officer who has requested a suspected
drunk driver to take a test to determine blood or breath alcohol content to
request and direct the driver to take a test other than what the driver has
elected if the officer determines there are extraordinary circumstances
that prevent the completion of the elected test within the required 2-hour
time period. Specifies that the driver's decision to change the test election
to comply with the officer's request shall not be deemed a refusal to
submit to testing. Specifies that the failure to comply with the officer's
request shall be deemed a refusal to submit to testing.

CO Works Alternative Earnings Income Disregard (SB 225)
Creates an alternative earnings income disregard calculation that
county departments of social services may choose to apply in determining
the authorized grant amounts for persons participating in the Colorado
works program.

Compliance with Federal Law Regarding Placement Children (SB 226)
To comply with the federal "Safe and Timely Interstate Placement
of Foster Children Act of 2006", to comply with the federal "Child and Family Services
Improvement Act of 2006", requires a court to consult with a child, in an
age-appropriate manner, regarding the child's permanency plan.
To comply with the federal "Adam Walsh Child Protection and
Safety Act of 2006". To comply with federal regulations, requires a relative or other
person who accepts a child for placement in his or her home to report to
a local law enforcement agency within a certain time period for the
purpose of providing fingerprints for a criminal history records check.
Requires the appropriate agency to remove the child from the home if
fingerprints are not provided in a timely manner.
